The department maintains the broker recovery fund to make payments of certain types of judgments against a mortgage broker or loan officer. Credit Score Disclosure

In connection with your application, a lender must disclose the scores to you that a consumer reporting agency distributed to users and the lender used in connection with your home loan, and the key factors affecting your loan

The credit score is a computer generated summary calculated at the time of the request and based on information a consumer reporting agency has on file. Credit scores can change over time, depending on your conduct, how your credit history and payment patterns change and how credit scoring technologies change over time.

Because your score is based on information in your credit history, it is very important that you review the credit related information that is being furnished to make sure it is accurate.

Mortgage Broker Disclosure

We will submit your loan application to a participating lender which we may vary from time to time:

contract upon such terms as you may request or a lender may require. In connection with this mortgage loan, we are acting as an independent contractor and not as your agent. We will enter into separate independent contractor with various lenders. While we we will seek to assist you in meeting your financial needs, we do not distribute the products of all lenders or investors in the market and cannot guarantee the lowest or best items available in the market

The retail price we offer you- your interest rate, total points and fees will include our compensation. In some cases we may be paid all or part of our compensation by you and the lender. Alternatively, we may be paid a portion of our compensation by both you and the lender. For example, in some cases if you would rather pay a lower interest rate you may pay higher up front points and fees. Also in some cases, if you would rather pay less upfront, you may be able to pay a higher rate, in which case some or all my compensation will be paid by the lender. We also may be paid by the lender based on other goods, services, or facilities performed or provided by us to the lender.

The estimated fees which we will charge will be shown on the good faith estimate which we are providing to you now or which we will provide within 3 days in accordance with the requirements of the Real Estate Settlement Procedure Act and its implementing regulations.

Information about Real Estate Brokerage Services:

Before working with a real estate broker, you should know that the duties of a broker depend on whom the broker represents. If you are a prospective seller or landlord (owner) or a prospective buyer or tenant (buyer), you should know that the broker who lists the for sale or lease is the owner's agent. A broker who acts as a subagent represents the owner in cooperation with the listing broker. A broker who acts as a buyer's agent represents the buyer. A broker may act as an intermediary between the parties if the parties consent in writing. A broker can assist you in locating a property, preparing a contract or lease, or obtaining financing without representing you. A broker is obligated by law to treat you honestly.

If the Broker represents the owner: The broker becomes the owner's agent by entering into an agreement with the owner usually through a written listing agreement or by agreeing to act as a subagent by accepting an offer of sub-agency from the listing broker. A listing broker or subagent can assist the buyer but does not represent the buyer and must place the interests of the owner first. The buyer should not tell the owner's agent anything the buyer would not want the owner to know because an owner's agent must disclose to the owner any material information known to the agent.

IF THE BROKER REPRESENTS THE BUYER:
The broker becomes the buyer’s agent by entering into an agreement to represent the buyer, usually through a written buyer representation agreement. A buyer’s agent
can assist the owner but does not represent the owner and must place the interests of the buyer first. The owner should not tell a buyer’s agent anything the owner would
not want the buyer to know because a buyer’s agent must disclose to the buyer any material information known to the agent.
IF THE BROKER ACTS AS AN INTERMEDIARY:
A broker may act as an intermediary between the parties if the broker complies with The Texas Real Estate License Act. The broker must obtain the written consent of each party to the transaction to act as an intermediary. The written consent must state who will pay the broker and, in conspicuous bold or underlined print, set forth the broker’s obligations as an intermediary. The broker is required to treat each party honestly and fairly and to comply with The Texas Real Estate License Act. A broker who acts
as an intermediary in a transaction:
(1) shall treat all parties honestly; (2) may not disclose that the owner will accept a price less than the asking price unless authorized in writing to do so by the owner; (3) may not disclose that the buyer will pay a price greater than the price submitted in a written offer unless authorized in writing to do so by the buyer; and (4) may not disclose any confidential information or
any information that a party specifically instructs the broker in writing not to disclose unless authorized in writing to disclose the information or required to do so by The Texas Real Estate License Act or a court order or if the information materially relates to the condition of the property. With the parties’ consent, a broker acting as an intermediary between the parties may appoint a person who is licensed under The Texas Real Estate License Act
and associated with the broker to communicate with and carry out instructions of one party and another person who is licensed under that Act and associated with the broker to communicate with and carry out instructions of the other party.
If you choose to have a broker represent you, you should enter into a written agreement with the broker that clearly establishes the broker’s obligations and your obligations. The agreement should state how and by
whom the broker will be paid. You have the right to choose the type of representation, if any, you wish to receive. Your payment of a fee to a broker does not necessarily establish that the broker represents you. If you
have any questions regarding the duties and responsibilities of the broker, you should resolve those questions before proceeding.

Your Privacy Rights:

To process customer home financing and commercial loan requests and keep customers informed, customers must provide their names, e-mail and street addresses, telephone numbers, income and other financial data. All of this information is stored in a secure manner and is not accessible through the Internet.

We respect your privacy and value your trust in us. We will do everything in our power to earn your confidence so that you can enthusiastically use our services and recommend us to friends and family. We do not collect the names or addresses of visitors to the Golden Vault web site.

We do not sell, rent or barter mailing lists of our customers or site visitors.

We do request and store the names, e-mail and street addresses, telephone numbers, numbers, income and other financial information for customers. This information is transmitted to respective mortgage lenders for the sole purpose of processing your request.

For the sole purpose of processing your request, Golden Vault may share the information you provide with up to four lending institutions participating in our program. All lenders operate under federal and state laws regarding customer privacy.

Occasionally, we may notify you about a special offer from one of our promotional partners. We do not reveal your name or address to that promotional partner unless you affirmatively respond to the promotional offer.

At your request, we will not send you any information or offers unrelated to your finance request.

Golden Vault may share non-personal aggregated data with other third parties for general marketing and demographic purposes.

Any changes to our privacy promise will be communicated through this web site at least 10 days in advance of implementation. Information collected before changes are made will be secured according to the old privacy policy.
